Law of the PEOPLE'S REPUBLIC OF CHINA on control of the entry and exit of aliens is the basic law of controlling of the entry and exit of aliens and enacted by Standing Committee of the National People's Congress in 1986.

ALIENS

Alien means any person not holding Chinese nationality according to the Nationality Law of the People's Republic of China. Aliens entering, leaving and transiting the territory of the People's Republic of China (PRC) and residing and travelling in China must obtain the permission of the competent authorities of the Chinese Government. For entry, exit and transit, aliens and foreign-owned means of transport must pass through ports open to aliens or other designated ports and must be subject to inspection by the frontier inspection offices.

VISA

As a rule, diplomatic visa, courtesy visa, service visa and ordinary visa shall be respectively issued to foreigners coming to China pursuant to their positions and the classification of their passports.

D-visa is issued to those coming to settle down in China; 

Z-visa is issued to those coming to China for holding posts or for employment as well as to their relatives in company;

X-visa is issued to those coming to China to study, take refreshment courses,and do practical training for a period exceeding six months;

F-visa is issued to those invited to visit, investigate, lecture, do business, conduct scientific, technological and cultural exchanges, and take short-term refreshment courses and do practical training, etc. for period not exceeding six months;

L-visa is issued to those coming to China to travel, to visit relatives or  entering China for other private matters. Such being the case, for those coming to China for travel in groups, a group visa can be accorded to groups containing more than 9 members;

G-visa is issued to those passing directly through Chinese territory;

C-visa is issued to those attendants, crew, and seamen and their relatives in company on trains, airplanes, and vessels operating on international routes for performing their respective duties;

ADMINISTRATIVE ORGANS

China's diplomatic missions, consular offices and other resident agencies abroad authorized by the Ministry of Foreign Affairs shall be the Chinese Government's agencies abroad to handle aliens' applications for entry and transit.

The Ministry of Public Security, its authorized local public security organs, the Ministry of Foreign Affairs and its authorized local foreign affairs departments shall be the Chinese Government's agencies in China to handle aliens applications for entry, transit, residence and travel.

ENTRY INTO THE COUNTRY

For entry into China, aliens shall apply for visas from Chinese diplomatic missions, consular offices or other resident agencies abroad authorized by the Ministry of Foreign Affairs. In specific situations aliens may, in compliance with the provisions of the State Council, apply for visas to visa-granting offices at ports designated by the competent authorities of the Chinese Government.

Visa organs stationed at ports authorized by the Ministry of Public Security are located at the following ports: Beijing, Shanghai, Tianjing, Dalian, Fuzhou, Xiamen, Xi'an, Guilin, Hangzhou,  Kunming, Guangzhou (Baiyun Airport), Shenzhen (Luohu, Shekou), and Zhuhai (Gongbei).

Aliens who have been invited or hired to work in China shall, when applying for visas, produce evidence of the invitation or employment.

Aliens desiring to reside permanently in China shall, present status-of-residence identification forms. Applicants may obtain such forms from public security organs at the place where they intend to reside.

RESIDENCE

For residence in China, aliens must possess identification papers or residence certificates issued by the competent authorities of the Chinese Government. For a temporary overnight stay in China, aliens shall complete registration procedures pursuant to the relevant provisions.

Aliens who have not acquired residence certificates or who are on a study programe in China may not seek employment in China without permission of the competent authorities of the Chinese Government.

TRAVEL

Aliens who hold valid visas or residence certificates may travel to places open to aliens as designated by the Chinese Government. Aliens desiring to travel to places closed to
aliens must apply to local public security organs for travel permits.
