We analyze the unfair competition implications of a particular transaction to determine whether and where pre-merger filings need to be made, and help the client to anticipate the relevant enforcement authority's approach to the transaction. Where warranted, we take an aggressive stance, promoting our clients' positions with briefing memoranda and/or oral presentations submitted prior to, contemporaneously with or subsequent to any business activity.

We actively negotiate with enforcement authority staff to resolve problems in a manner that meets the business needs of our clients. We have negotiated with government enforcement agencies to resolve issues arising in their investigation and to modify or terminate consent decrees. Where appropriate, we have also opposed the modification or termination of existing decrees and decisions. When other measures fail, we litigate successfully against enforcement authorities to achieve our clients'goals.
